Welcome to Where Adults Meet ("we," "our," or "us"). By accessing or using our dating platform, website, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

You must be at least 18 years old to use our Service. By creating an account, you represent and warrant that:

• You are not prohibited from using the Service under Australian law or any other applicable jurisdiction
• You have not been previously banned or removed from the Service

Your profile represents you to the community. All profile content must:

• Be of yourself (no photos of other people, celebrities, or children)
• Be appropriate and respectful (no nudity, sexually explicit content, or violence)
• Not contain contact information, links to external sites, or promotional content
• Not infringe on any copyright, trademark, or privacy rights
• Be current and accurately represent your appearance

We reserve the right to remove any content that violates these guidelines without notice.

While basic access to the Service may be free, certain premium features require a paid subscription. By purchasing a subscription, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate and complete payment information
• Authorize us to charge your payment method for recurring subscriptions

Subscriptions: Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings. Refunds are provided in accordance with our Refund Policy.

Price Changes: We reserve the right to modify subscription fees with at least 30 days' notice. Continued use after price changes constitutes acceptance.

The Service, including all content, features, and functionality, is owned by Where Adults Meet and protected by Australian and international copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of content you post but grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with the Service.

Our Content: You may not copy, modify, distribute, or create derivative works from our content without express written permission.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

We comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

Your safety is our priority. We provide tools to report and block users, but we cannot guarantee the conduct of other users. You should:

• Exercise caution when communicating with other users
• Never share financial information or send money to other users
• Meet in public places for first dates
• Report suspicious behavior or profiles immediately
• Review our Safety Tips for additional guidance

We investigate all reports but are not responsible for user conduct outside our platform.

We may suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse or harassment of other users
• Extended periods of inactivity
• Any reason we deem necessary to protect the Service or our users

You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

Service "As Is": The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Results: We do not guarantee that you will find a match or form a relationship through the Service. Success depends on many factors outside our control.

Limitation of Liability: To the maximum extent permitted by Australian law, Where Adults Meet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Loss of profits, revenue, or data
• Personal injury or property damage
• User conduct or content
• Service interruptions or errors

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.

You agree to indemnify, defend, and hold harmless Where Adults Meet, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Your content posted on the Service

Governing Law: These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles.

Disputes: Any dispute arising from these Terms or the Service shall first be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Brisbane, Queensland, in accordance with the Resolution Institute Arbitration Rules.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of use of third-party services. Your use of third-party services is at your own risk.

Nothing in these Terms excludes, restricts, or modifies any consumer rights or remedies under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other applicable Australian consumer protection laws that cannot be excluded, restricted, or modified by agreement.

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Where Adults Meet.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
