Welcome to Where Adults Meet ("we," "our," or "us"). By accessing or using our dating platform, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

You must be at least 18 years old to use our Service. By creating an account, you represent and warrant that:

• You have the legal capacity to enter into a binding contract
• You are not prohibited from using the Service under Australian law or any other applicable jurisdiction
• You have not been previously banned or removed from the Service

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

You are solely responsible for your conduct and any content you post. You agree NOT to:

• Post false, misleading, or fraudulent information
• Impersonate any person or entity
• Use the Service for any illegal or unauthorised purpose
• Harass, abuse, threaten, or intimidate other users
• Post content that is defamatory, obscene, pornographic, or offensive
• Violate any intellectual property rights
• Spam, solicit, or promote commercial activities without authorisation
• Use automated systems (bots, scrapers) to access the Service
• Share or distribute viruses, malware, or harmful code

All profile content must:

• Be of yourself (no photos of other people, celebrities, or children)
• Be appropriate and respectful (no nudity, sexually explicit content, or violence)
• Not contain contact information, links to external sites, or promotional content
• Not infringe on any copyright, trademark, or privacy rights
• Be current and accurately represent your appearance

We reserve the right to remove any content that violates these guidelines without notice.

Certain premium features require a paid subscription. By purchasing a subscription, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate and complete payment information
• Authorise us to charge your payment method for recurring subscriptions via PayPal

Subscriptions: Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through Settings > Membership. Refunds are provided per our 30-day money-back guarantee.

Price Changes: We reserve the right to modify subscription fees with at least 30 days' notice. Continued use after price changes constitutes acceptance.

The Service, including all content, features, and functionality, is owned by WAM and protected by Australian and international copyright, trademark, and intellectual property laws.

Your Content: You retain ownership of content you post but grant us a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute your content in connection with the Service.

Our Content: You may not copy, modify, distribute, or create derivative works from our content without express written permission.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

We provide tools to report and block users, but cannot guarantee the conduct of other users. You should:

• Exercise caution when communicating with other users
• Never share financial information or send money to other users
• Meet in public places for first dates
• Report suspicious behaviour immediately
• Review our Safety Tips page for additional guidance

We may suspend or terminate your account at any time for violation of these Terms, fraudulent or illegal activity, harassment of other users, extended inactivity, or any reason necessary to protect the Service or our users.

You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

Service "As Is": The Service is provided "as is" and "as available" without warranties of any kind.

No Guarantee of Results: We do not guarantee that you will find a match or form a relationship through the Service.

Limitation of Liability: To the maximum extent permitted by Australian law, WAM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.

You agree to indemnify and hold harmless WAM, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, your violation of these Terms, or content you post.

Governing Law: These Terms are governed by the laws of Queensland, Australia.

Disputes: Any dispute shall first be resolved through good faith negotiation. If that fails, disputes will be resolved through binding arbitration in Brisbane, Queensland, per the Resolution Institute Arbitration Rules.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.

Nothing in these Terms excludes, restricts, or modifies any consumer rights or remedies under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other applicable Australian consumer protection laws.

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and WAM.

Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force.

Waiver: Our failure to enforce any right does not constitute a waiver of that right.

Assignment: You may not assign these Terms without our written consent. We may assign these Terms without restriction.
